The below terms and conditions apply to all deliveries from
Samson Agro A/S

to customers purchasing goods via www.samson-agro.com or another designated website of Samson Agro online shop.
1. Conclusion of contracts
Samson Agro reserves the right to claim that prices have been misprinted on the Samson Agro online shop.
A final and binding agreement between you and Samson Agro has been concluded when your order has been accepted by Samson Agro. Samson Agro will send an order confirmation to you by email when the order has been accepted and the shipping is underway.
The order receipt received immediately after submitting the order does not constitute an order confirmation.
2. Prices and payment
We accept the following credit cards:

All prices are stated inclusive of Danish VAT and other Danish charges. The applicable price is the one stated on Samson Agro online shop in respect of the relevant product on the date of placing the order.
Any customs or import duties are charged once the order reaches its destination country and must be paid by the recipient of the order.
We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country.
You may want to contact your local customs office for further information. All orders are sent from Denmark.
When ordering products via Samson Agro online shop shipping costs will be added.
Samson Agro reserves the right to amend prices, fees and/or other costs stated on Samson Agro online shop at any time e.g. due to changes in VAT-rates or other public fees and charges, increase in cost level, or as a result of the usual development in retail prices based on June 2011 prices in Denmark.
Samson Agro reserves the right to exclude persons from purchasing via Samson Agro online shop.
Furthermore, Samson Agro has no obligation to deliver goods which are out of stock.
Samson Agro will usually accept the order and ship the order within 48 hours on working days. Samson Agro cooperates with several.
The usual time of shipment is 1-3 weekdays and delivery may vary from country to country.
4. Returning products/services
Returning a service/product is to be done on your expense, unless the product/service is faulty or damaged upon delivery. Returned products/services are to be sent as letters or postal packages, and not for COD. In case of a trade, Samson Agro will pay for the delivery of the replacement product/service.
5. Return Policy / Right of withdrawal
You are entitled to withdraw from the contract within 14 days as from the date of your receipt of the product. You may exercise your right of withdrawal without stating any specific reason and by communicating your decision to us by ordinary letter or by email. You may, but you are not required to, use the model withdrawal form linked to here: WITHDRAWAL FORM
PLEASE NOTE: You cannot exercise your right of withdrawal by simply refusing receipt of the product or by failing to collect the product from the carrier.

In order for us to identify the product, we request that you state the order number when communicating your decision to withdraw from the contract. Failure to state the order number may cause errors or delays.
If you communicate your decision to withdraw from the contract, you must subsequently return the product to us at the same physical address stated above without any undue delay and no later than two weeks after communicating your decision to withdraw from the contract. We may demand documentation proving that the product was sent prior to expiry of such deadline. If returning a product by mail, you must make sure that it is packed with due care considering the special nature of the product.
PLEASE NOTE: The right of withdrawal cannot be exercised by handing in the product to our physical shops or to our distributors.
PLEASE NOTE: You are liable for any damage occurring during carriage. Please note as well that you must pay the costs incidental to returning the product, unless we have delivered the product to you by a mistake or if the product was damaged or defective upon receipt. We are not able to state the price of returning product beforehand since this depends on the weight of the product to be returned and your choice of carrier, etc. It is, however, likely that the return of the product will cost at least the same price of delivery as paid by you in the Online Shop (provided that the delivery was not free of charge).
Product must be returned in a good and undamaged condition. If returned product is damaged or shows signs of use, other than what is required to establish the nature, characteristics and functioning of the product, you will be liable for any loss of value of such product. We will estimate any value by way of a specific assessment of the product returned based on the following guidelines for loss of value:
The product is returned in undamaged original packaging: 0% loss of value.
The product is returned without original packaging or in damaged original packaging: approx. 10% loss of value
Condition of product
The product is returned in unused and undamaged condition: 0% loss of value
The product is returned in used condition: approx. 50% loss of value
The product is returned in damaged condition which, for example, includes chipped products: approx. 100% loss of value
Payment for the product will be reimbursed as soon as possible and, in all circumstances, no later than two weeks after our receipt of your communication of your decision to withdraw from the contract. However, we reserve the right to withhold such reimbursement until we have received the product for inspection or until you have supplied evidence of having returned the product, whichever is the earliest.
If you decide to withdraw from the contract in accordance with these terms and conditions, we will reimburse the purchase price together with the original freight costs (however, not any additional costs incurred as a consequence of you opting for a type of delivery other than the least expensive type of standard delivery) less any loss of value. Unless otherwise expressly stated, we will carry out the reimbursement by using the same means of payment as the one used by you to perform the initial transaction.

6. Liability / Warranty
If the package or its content is damaged upon arrival, please report this to SAMSON AGRO A/S within reasonable time and no later than two months from receipt.
Irrespective of whether any errors or defects are ascertained upon receipt or at a later date, all product is subject to the Danish Sale of Goods Act (købeloven), giving you 24 months to complain about an product. However, if the errors or defects are due to your negligence, abuse or other incorrect use, your right to complain will lapse.

Samson Agro A/S will cover any reasonable freight costs in the event of notification of defects, unless such notification of defects proves to be unjustified.
Furthermore, you may at any time file a complaint with the Consumer Complaints Board (Forbrugerklagenævnet) via the following link (please note, however, the complaint conditions of the Complaints Board applicable from time to time, including thresholds): http://www.forbrug.dk/Dineklagemuligheder/Saadan-klager-du/Klag-til-Forbrugerklagenaevnet.
Samson Agro is not liable for delays or for non-performance due to force majeure. For as long as a force majeure situation persists, Samson Agro is relieved from performance of its obligations.
Samson Agro's liability for any and all claims, including damages is in any circumstances, except in case of unlawful intent or gross negligence, and in addition to the above, limited to an amount equal to the price of the good purchased by the customer relating to the dispute. The aforesaid monetary limitation applies irrespective of the basis hereof and includes claims based on acts of negligence, strict liability, breach of warranties, penalties, liquidated damages and/or punitive damages.
Samson Agro assumes product liability vis-a-vis consumers under applicable law without any limitations.
7. Data protection and privacy
We shall collect, process and save all personal information provided by you exclusively in accordance with the provisions specified by the Danish Data Privacy Law.
